Terms and Conditions

BOOKING A COURSE

  1. “Academy” refers to The Nails and Beauty Academy, a trading name of Reach Future Limited, company registration number 08900795.

  2. "I" refers to the Student/Model.

  3. “Student” refers to the person attending a Nails and Beauty Academy training course/s.

  4. "Model" refers to any person receiving any treatments from a Student whilst attending a Nails and Beauty Academy training course/s 

  5. "Booking Form(s)" refers to completed online Booking Forms only; no other mechanism of submitting a completed Booking Form is accepted by the Academy.

  6. The Booking Form, received by the Academy, forms the basis of the contract between the Academy and the Student; in submitting the Booking Form the Student agrees to the terms and conditions referred to in this Booking Form. The terms and conditions referred to in the Booking Form are held entirely and exclusively in this document.

  7. Upon receipt of the Student(s) Booking Form and also full payment in advance of the course start date, we will confirm your place on the course. A group booking is not accepted until all individual parties of the group booking have completed and submitted their own individual online Booking Form and made full payment in advance of the course start date.

  8. A Student is accepted for enrolment subject to the conditions that the Student will attend on the correct start date of the course and at the time specified in the confirmation e-mail which will be sent to the Student upon receipt of the completed Booking Form, together with the correct payment.

  9. Any and all Student(s) will not be accepted on the start date of the chosen course unless each individual Student has completed and submitted their own online Booking Form. This individual online Booking Form must be submitted and accepted by the Academy before any payment can be accepted by the Academy. All course payments must be made in full and in advance of the start date of the course. A group booking is not accepted until all individual parties of the group booking have first completed and submitted their own individual online Booking Form to the Academy and also made their own individual full payment in advance of the course start date. Mere mention of a group booking or mention of the numbers anticipated in a group booking does not make the booking a group booking. Mentioning a group booking on a Booking Form is not accepted as a group booking until all parties of a group booking have also completed an individual online Booking Form and also made full payment in advance of the course start date; where a Student has mentioned a group booking on an individual online Booking Form but other parties to the group have failed to submit their own individual online Booking Form, the group booking section on the online Booking Form will be isolated, dismissed and ignored and will instead be processed as an individual booking relevant only to the Student named on the completed online Booking Form submitted to the Academy and full payment of the course will be required by this individual Student in advance of the start date of the course.

    The price on any and all Booking Forms is the price to be paid per individual Student and is not the collective price for any group booking.

    In addition to a completed online individual Booking Form submitted to the Academy, ALL payments must be made by ALL individual parties prior to the start date of the course. If any party of a group booking fails to pay the agreed price stated on their individual Booking Form prior to the start date of the course, then all Students party to an accepted group booking will be refused entry or will be required to pay the difference between the group booking discount price and the normal price, whatever the difference may be, where discounts are applicable for some courses. Please note that not all courses offer discounts.

  10. The Booking Form is a legal document and if the information provided on the Booking Form is found to be untruthful and or inaccurate the Academy reserves the right to refuse entry to any Student and a refund will not be provided.

  11. Refusal to provide information that can assist with verifying information contained in the Student(s) Booking Form will be construed as objectionable and uncooperative conduct and will lead to automatic refusal of admission and refunds will not be provided.

  12. Third parties paying for the course(s) have a duty of care and obligation to ensure that all aspects of the Student(s) Booking Form are truthful and accurate.

  13. Course fees, deposits and other payments are non-transferable.

  14. Fees are not refundable if the course is interrupted or cancelled through an act of God.

  15. Refunds are only available for any of our courses, where course venue, dates or times are changed by the Nails and Beauty Academy. In any other circumstances, refunds are not available. Refunds are limited to course fees alone, which are paid for by the Student to the Academy; refunds will not be available, under any circumstances, for any other costs incurred, including but not exclusive to any loss of earnings, any loss of time, any travel costs, any accommodation costs, and or any other expenses.

  16. The Academy accepts no responsibility for lost or damaged belongings. It is the responsibility of the Student to ensure the safety and security of their personal belongings at all times.

  17. The Nails and Beauty Academy reserve the right to change the location of the training room, dates and times, and that Students will be advised in advance of any such changes.

  18. Where successful completion of a course requires a Student to submit portfolio evidence and or coursework and that this evidence is deemed to be of a satisfactory standard, the Student will be awarded the appropriate certificate. If the original certificate is awarded after the last day of attendance on the course, the Student will need to pay for international delivery costs. Where portfolios and or coursework are not required and the course has been successfully completed by the Student, certificates will be issued directly to the Student on the last day of the course attendance. Where a Student has not successfully completed a course a certificate will not be awarded under any circumstances and the Student will not be permitted to resubmit or re-attend course modules.

  19. It is essential that Students ensure the safety of the certificates they are awarded with following successful completion of any course provided by the Academy. Duplicate certificates will not be printed by the Academy under any circumstances. Students who have failed to successfully complete the course will not be issued with any certificate.

  20. The Nails and Beauty Academy reserve the right to refuse admission to any course(s) at the Academy where the applicant(s) and or Student(s) and or the Student(s)' Model and or third party representing either the Student or Student's Model have been abusive, objectionable, rude and or uncooperative towards any member of staff of the Academy at any time. Where the Academy has found an applicant and or a Student and or a Student's Model and or third party representing either the Student or the Student's Model to be abusive, objectionable, rude and or uncooperative towards any member of staff of the Academy at any time, the fees for the course, or any other costs incurred, including but not exclusive to any loss of earnings, any loss of time, any travel costs, any accommodation costs, any nuisance and or inconvenience, and or any other expenses, will not be refunded. The Academy is not in any way liable for any costs associated with attending this course, including but not limited to those above mentioned, where a Student is refused entry.

  21. The Nails and Beauty Academy reserve the right to refuse admission to any course(s) at the Academy where the applicant(s) and or Student(s) and or the Student(s)' Model and or a third party representing either the Student or Student's Model have been abusive, objectionable, rude and or uncooperative towards any member of staff or other Student of the Academy at any time. Where the Academy has found an applicant of a group booking and or a Student of a group booking and or a Student's Model of a group booking or a third party representing either the applicant of a group booking and or a Student of a group booking and or a Student's Model of a group booking, to be abusive, objectionable, rude and or uncooperative towards any member of staff and or other Student of the Academy at any time, the fees for the course, or any other costs incurred, including but not exclusive to any loss of earnings, any loss of time, any travel costs, any accommodation costs, any nuisance and or inconvenience, and or any other expenses, will not be refunded to any party. The Academy is not in any way liable for any costs associated with attending this course, including but not limited to those above mentioned, where applicant(s) and or Student(s) and or the Student(s)'Model and or a third part representing either the Student or the Student's Model is or are refused entry.

  22. The third party paying or representing  the Student and or Model has a duty of care to ensure that the Student and or Model and or themselves do not behave in a rude, objectionable or uncooperative manner. Should the Academy institute legal proceedings against the Student and or Model and or third party paying or representing the Student and or Model, the Student and or Model and or third party paying or representing the Student and or Model, will be liable for all costs and all damages awarded.

  23. Without exception, the Student(s) must be prepared for other Students to work on them as Model(s) and must cooperate and participate in any and all aspects of receiving and delivering the treatments as instructed by the tutor. The Student(s) failure to participate as instructed by the tutor, in receiving and delivering treatments from and to other Students will be considered a serious breach of the Student(s) obligations to properly participate in all aspects of the course. Failure to participate in receiving and delivering treatments from and to other Students will lead to refusal of admission at any point during the course and fees paid for the course will not be refunded.

  24. Exclusively and without exception, the Student is expected to cooperate and exclusively watch the teacher demonstrating a treatment, without participating in any other activity or excercise. Failure to cooperate and exclusively watch the teacher demonstrate a treatment will lead to automatic refusal of admission to the course and refunds will not be provided.

  25. Without exception, the Student(s) must be prepared for other Students to work on them as Model(s). This includes but is not limited to: removing all make-up, eyelash extensions, any and all nail treatments, overlays and or false nail extensions, length of natural nails, bracelets and necklaces. If a Student does not remove any or all items and or aspects required for the furtherance of the treatment that may prevent another Student from properly working on them as a Model, the tutor may refuse admission to the training course and fees paid for the course will not be refunded.

  26. Where a Student suffers from a medical condition that could be affected by participating in any way in a treatment or technique taught on the course of their choice, the onus is on that Student to consult his or her GP, prior to booking their course, to confirm that participating in their chosen course poses no detrimental risk to their health. Should a Student fail to undertake this obligation, and subsequently becomes ill or their medical condition becomes worse as a result of their participation in a treatment or technique taught at or by this Academy, then this Academy cannot be held responsible for any deterioration in that Student’s health or medical condition. Similarly, should it be deemed, at any stage during the Student's training with the Academy, that the Student’s medical condition has deteriorated, whether or not that Student has properly undertaken their obligation to consult with their GP to obtain approval before embarking on their chosen course, the Academy reserve the right to withdraw that Student for all or any part of that Student’s course and that Student will not be entitled to any reimbursement of fees paid.


  27. Students and or Models are expected to consult their GP should they have or are suspected to have an infection which may cause harm to others.  Where a member of staff notices that a Student or Model may have an infection which may be harmful to others, and suspects that the Student or Model may not have consulted their GP to seek assurance that it is not contagious, the Academy reserves the right to refuse the Student or Model entry and a refund will not be provided, where the Student or Model is not able to provide a doctor’s note to confirm the nature of the infection, or where the doctor’s note confirms that the infection could be contagious.  Where a Student has been excluded on suspicion of having an infection that could be contagious to others and it materialises, through a doctor’s note, that the suspected infection is not in fact contagious, then the Academy will either refund the Student the remainder of the course fees for the days that she has not attended or may transfer her to attend the absented days of the same course on an alternative date.  The Academy is not in any way liable to ascertain the nature of a Student or Model’s medical condition or to understand its possible effects on other Students or Models or staff.  The Academy is not in any way liable for any costs associated with attending this course, including but not limited to loss of earnings; travel expenses; accommodation costs; nuisance and inconvenience etc.  The Academy is not in any way liable for any costs associated with attending this course, including but not limited to those above mentioned, where a Student is refused entry. In providing a doctor’s note the Student or Model is also confirming his or her agreement to allow the Academy to consult the Student or Model’s doctor regarding any note drafted. It is at the discretion of the Academy whether or not to contact the Student or Model’s GP and the Academy cannot be held liable, in any way, by not doing so.



  28. Student(s) and or Model(s) are expected to advise the Nails and Beauty Academy prior to booking a course, in the Medical Information section of the Booking Form, of any medical condition/contra-indications/disabilities, in order that arrangements can be made by the Academy to accommodate such, where possible. Failure to insert details of any medical condition/contra-indications/disabilities into the Booking Form, will mean that the Academy does not have advanced warning of any medical condition/contra-indications/disabilities, which is essential to allow the Academy to allocate a more suitable training venue that is properly equipped for certain medical conditions/contra-indications/disabilities. Failure to insert details of any medical condition/contra-indications/disabilities may mean that a Student and or Model is allocated a centre that is not suitable for their needs. The onus is on the Student to properly advise, by completing the Booking Form and inserting details of any medical condition/contra-indications/disabilities of the Student and Model; in failing to properly advise the Academy, the Academy can not be held responsible for not providing suitable facilities for any medical condition/contra-indications/disabilities of the Student or Model. Should a Student and or Model book onto a course and have failed to previously advise in the Medical Information section of the Booking Form, in advance of booking the course with the Academy, of any medical condition/contra-indications/disabilities of the Student and Model, that Student and Model will be refused admittance on to the course and will not be entitled to defer the course to a later date or to be allocated an alternative centre or to obtain a refund of any kind. Should a Student book onto a course and have failed to previously advise in the Medical Information section of the Booking Form, in advance of booking the course with the Academy, of any medical condition/contra-indications/disabilities of the Student, that Student will be refused admittance on to the course and will not be entitled to defer the course to a later date or to be allocated an alternative centre or to obtain a refund of any kind.

  29. All applicants must be over the age of 16.

    CONDUCT


  30. The awarding of certificates is not automatic. Diplomas and certificates are only awarded when all aspects of the course are successfully completed to the required standard. Should Students fail to or refuse to follow the teacher's instructions, they will not be awarded a diploma or certificate.

  31. If any Student behaves improperly at any Nails and Beauty Academy centres, damages or removes any equipment, is abusive, objectionable, rude and or uncooperative towards any staff members or fellow Students, they will be asked to leave immediately and a refund will not be provided.

    GENERAL

  32. The Nails and Beauty Academy reserves the right to update these terms and conditions without notice to you.

  33. In agreeing to the terms and conditions the Students and or their Model(s) must participate in classroom photos and or film, which will be used for the Academy marketing purposes only.

  34. Students accept that any photographs submitted to the Nails and Beauty Academy may be used by the Academy for any purpose. By submitting photographs, you acknowledge that all ownership of the photograph(s)/image(s) is transferred to the Academy and, therefore, copyright of the Nails and Beauty Academy (which is a trading name of Reach Future Limited), their respective administrators, owners and directors.

  35. Classes will begin promptly at the published times, irrespective of whether all Students are present. Classes will not be delayed to wait for latecomers and teaching staff are not responsible for repeating work missed. Late arrivals will be refused entry and refunds will not be provided.

  36. All course bookings will be conducted by e-mail and confirmation of course reservation will likewise be sent by e-mail to the Student's e-mail address as stated on his/her Booking Form. It is entirely the obligation of the Student to ensure that this confirmation e-mail is either copied, saved or printed out for future reference; it is in no way the obligation of Academy to enforce or ensure that the Student complies with this guideline. Should the Student fail to save a copy or print out their confirmation e-mail, the Nails and Beauty Academy are not in anyway responsible for this failure and will as such not be held liable in any way for such failure and any resulting losses. In short, should the Student fail to save, copy or print out their confirming e-mail then any developments are entirely the responsibility of the Student and any losses are entirely to be met by the Student.

  37. Students accept that any images, videos and any other form of recordings of themselves and/or any and all work submitted or otherwise is copyright of the Academy and may be used for any purpose including, but not limited to, marketing and/or course material now and in perpetuity. 

  38. A valid photo ID is required when you begin a course at The Nails and Beauty Academy failure to produce photo ID for inspection will result in automatic refusal of admittance to the course and refunds will not be provided under any circumstances.

  39. Only where a teacher is unforeseeably absent, will a course be cancelled and only in this circumstance will course fees alone, that are paid for by the Student to the Academy, will be refunded. Refunds will not be available, under any circumstances, for any other costs incurred, including but not exclusive to any loss of earnings, any loss of time, any travel costs, any accommodation costs, any nuisance and or inconvenience, and or any other expenses incurred by the Student, their Model or any other party.



  40. Students on any course at the Academy attend at their own risk. The Academy bears no responsibility for any items lost, damaged or stolen, belonging to any Student, while at the Academy.

If a Student or anyone representing the Student or anyone intending/actually paying for the Student's order of products from www.nailsupplies247.co.uk is abusive and or objectionable to Nails and Beauty Academy and or www.nailsupplies247.co.uk staff, then the Student's right to a one-time 10% discount will be withdrawn and any outstanding orders will be cancelled and refunded, and they will not be permitted to place a first or any subsequent order with www.nailsupplies247.co.uk

  44. The offer of a One-time 10% discount from orders placed online at www.nailsupplies247.co.uk is at the discretion of www.NailSupplies247.co.uk and the offer may be revoked on an individual basis at any time.   45. VRQ Qualifications

  46. Students must complete the required case studies, assignments and portfolio and be available to complete any and all assessments and exams at the times and dates scheduled by the Academy for any and all VRQ training programs at the Academy. Failure to meet these requirements, necessary submission deadline dates, scheduled assessment and exam dates, will lead to automatic disqualification from the course. Resits, resubmissions and refunds are not possible.

  47. Mock-examination, assessment and ITEC-invigilated examination will be scheduled a minimum of 3 months after registering for any and all VRQ course, the Student must make themselves available at this stage for such examinations and assessment.  The mock examination, assessment, and ITEC-invigilated examination dates, for any and all VRQ course provided by the Academy to the Student, are not negotiable and must be attended by the Students with their own Models. The Student must, without exception, make themselves available to attend for examination on the dates scheduled by the Academy. Failure to attend, for whatever reason, will result in an automatic failure of the entire course and will automatically preclude the Student from continuing any further with the course at the Academy. It is essential that Students must ensure that they have undertaken and completed all the work required for the VRQ course, by the minimum stage of 3 months after registering for any and all VRQ course(s) at the Academy.  The Academy does not offer re-sits for any of its VRQ qualifications. Refunds will not be available, under any circumstances, for any costs incurred, including but not exclusive to course fees, any loss of earnings, any loss of time, any travel costs, any accommodation costs, and or any other expenses or losses.

  48. Student(s) and their Model(s) must arrive promptly at the allocated time without exception. Late arrivals of Student(s) or their Model(s) will mean automatic disqualification for the Student and re-sits for any and all examinations and or assesments are not available with the Nails and Beauty Academy. Refunds will not be available, under any circumstances, for any costs incurred, including but not exclusive to course fees, any loss of earnings, any loss of time, any travel costs, any accommodation costs, and or any other expenses or losses.

  49. The VRQ Level 2 Certificate in Nail Technology is accepted for licensing purposes in Hammersmith and Fulham, Westminster and Brent. The VRQ level 2 Certificate in Nail Technology has the same credit level with OFQUAL as the NVQ level 2 in Nail Services. The Academy is not responsible for ensuring the VRQ qualifications are acceptable for licensing purposes in the borough in which the Student wishes to be licensed to work. It is not the Academy's responsibility to check with the boroughs that the chosen VRQ qualification is acceptable to them. Should the VRQ qualification not be acceptable in the chosen borough, it is not the responsibility of the Academy. It is the Student's responsibility, before registering for this course, to verify with their council and licensing authority whether the VRQ is acceptable for licensing purposes. As it is the Student's obligation to check with their chosen council and licensing authority that the VRQ level 2 Certificate in Nail Technology is acceptable for licensing purposes, should the Student find that upon submitting an application for a license, the VRQ level 2 Certificate in Nail Technology is not acceptable for licensing purposes, the Academy cannot be held responsible and will not refund or compensate in any way.

  50. Should a Student need to re-submit work and or re-sit exams and or assessments, the Student will be required to pay extra charges for this, or will not be submitted for such exams, assessments and or re-submitted work will not be accepted. In registering for the course, Students must have successfully completed all work, assessments and examinations within 12 months from the date of registering with the Academy. If any work, assessments and or exams have not been successfully completed within 12 months from registering for the course with the Academy, Students will not be entitled to submit work or be entered for assessments and or examinations under any circumstances and will not be entitled to a refund of any kind.


  51. RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ("AGREEMENT") 

  52. Students are entirely responsible for the welfare and safety of their Models. It is entirely the obligation of the Students, and is not, in any way, the responsibility of the Academy, to ascertain the suitability or Medical Conditions/Contra-indications/Disabilities of their Model. Where the Model has a Medical Condition/Contra-indication/Disability, the Student needs to ensure that the Model has properly sought the approval of his or her GP to attend and participate as a Model on the Student's chosen course. It is the duty of the Model to seek the agreement of the GP to confirm that there is no risk to the Model, whilst the Model is receiving the treatment performed by the Student and also that there is no risk to the Model after this treatment has been performed by the Student. It is the duty of the Model to seek the agreement of the GP to confirm that there is no risk to the Student, whilst the Student is performing the treatment on the Model or after the Student has performed the treatment on the Model. The Student and also their Model accept that the Academy can not be held in any way liable for any risk of injury or actual injury to either the Student or their Model, either during the performance of the treatment or after the treatment has been performed at the Academy.

  53. It is the duty of the Model to ascertain what is involved in their participating as a Model on the Student's chosen course. In participating as a Model, it is assumed that the Model has undertaken this duty.

  54. It is entirely the responsibility of the Model to protect their own welfare and safety, before, during and after participating as a Model for the Student, on the Student's chosen course. It is entirely the responsibility and obligation of the Model and is not, in any way, the responsibility of the Academy, to ascertain the suitability or Medical Conditions/Contra-indications/Disabilities of the Student to perform a treatment on a Model. Where the Student has a Medical Condition/Contra-indication/Disability, the Model needs to ensure that he or she has properly sought the approval of the Student's GP, to ensure that their is no risk to the Model, whilst the Model is receiving the treatment performed by the Student and also that there is no risk to the Model after this treatment has been performed by the Student. The Student and also their Model accept that the Academy can not be held in any way liable for any risk of injury or actual injury to either the Student or their Model, either during the performance of the treatment or after the treatment has been performed at the Academy.

  55. It is the duty of the Model to ascertain what is involved in participating as a Model on the Student's chosen course. It is the duty of the Model to ascertain what is involved in the treatment he or she is going to receive as a Model for the Student on the Student's chosen course. It is entirely the Model's responsibility to assess the risks involved in participating in the treatment as a Model to the Student on the Student's chosen course. The Model and also the Student accept that the Academy can not be held in any way liable to assess or ascertain any risk to either the Model or the Student; the Model and also the Student accept that the Academy can not be held in any way liable for any possible or actual risk to either the Model or the Student; the Model and also the Student accept that the Academy can not be held in any way liable for any injury or damages or costs to either the Model or the Student arising as a result of participating as either a Model or a Student on the Student's chosen course.

  56. Students are entirely responsible for the welfare and safety of their Models. Students have obtained the agreement of their Model to these terms and conditions and, in participating as a Model for the Student, on any or all courses at the Academy, the Model is sanctioning their agreement that all these terms and conditions herein are accepted and apply to the Model and or the Student and that the Model and or Student are entirely bound by such terms and conditions.

  57. Students must make appropriate arrangements to remove any overlays outside of the training venue. Students are not permitted to remove overlays during or after their course within the training venue.

  58. IN CONSIDERATION of being permitted to participate in any way in any of Nails and Beauty Academy course/courses (“the Activity”) I (the Student/Model), for myself, for personal representatives, assigns, heirs, and next of kin:

    55.1 ACKNOWLEDGE, agree, and represent that I understand the nature of  the Activity and that I am qualified, in good health, and in proper physical condition to participate in the Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.

    55.2 FULLY UNDERSTAND THAT: (a) the Activity INVOLVES RISKS AND DANGERS OF ANY AND OR MINOR OR SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("Risks"); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inaction’s of others involved in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "Releasees" NAMED BELOW; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation in the Activity.

    55.3 HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Nails and Beauty Academy (which is a trading name of Cheta Limited), their respective administrators, owners, directors, agents, officers, members, Students, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the "Releasees" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "Releasees" AND OR OTHERWISE, INCLUDING NEGLIGENT REMEDIAL ACTIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the “Releasees”, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, legal fees, loss, liability, damage, or cost which may incur as the result of such claim.

    55.4 I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THE NAILS AND BEAUTY ACADEMY BOOKING FORM, WHICH REFERS TO THESE TERMS AND CONDITIONS AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
